Dear Ms Casaburi,
Following your recent correspondence to us.
On behalf of Ryanair, we sincerely apologise for the delay to your recent flight the FR9462 from Milan to Ciampino on the 24.12.2008 caused by a previous cancellation due to a diversion, outside of our control.
Ryanair is committed to providing on time services for all passengers and continues to be the No. 1 on-time airline in Europe, as detailed in audited statistics issued by the UK Civil Aviation Authority.
Our handling agent at Milan Airport have confirmed that the EU261 Article 14.1 notice was displayed at Check-In and the Article 14.2 notices was distributed to passengers affected by this delay.
For your information flight delays do not fall under the remit of Article 7 of EU Reg 261/2004 and as such monetary compensation is not due in this case.
From our records we note that you chose not to be rebooked onto an alternative flight or to continue your travel with Ryanair. As such, the airline compelled regulation is to process a full refund of the unused flight.
In accordance with the above mentioned, the amount of 42.22 EUR representing your unused flight, has been processed back to the original form of payment used when making your original flight reservation and this refund will be reflected on your next statement.
As this flight cancellation was outside of the control of Ryanair (extraordinary circumstances) we regret to advise that no monetary compensation is due under Article 7 of EU261/2004.
We would like to remind you that, as you received a refund, the airline has no further liability under Article 9 - Right to Care and no further compensation is due.
We regret we can not be of further assistance although we recommend contacting your travel insurer for further inquiries.
Yours sincerely
